  • Traffic Stop "Unnecessary"

    Just left the morning staff meeting. In following up on a couple cases that started from traffic stops and ended up in Federal District Court. One case resulted from a "California stop" at a stop sign. The other was failure to maintain a single lane, "weaving over the center stripe." Both traffic stops were video recorded, as were the violations. In the two separate cases, both defendants were "bad guys." One had a prior murder conviction and was found with a gun and drugs. The other had priors, I don't know exactly what, but had dope and a gun in the case. The Feds took up both cases on the Armed Career Criminal Statutes.

    The defense, in both cases, requested a Rule 41 Hearing or a Suppression hearing. This is a hearing just to test the probable cause of the encounter. If an error is found on the part of law enforcement, according to the fruit of the poisonous tree doctrine, the resulting evidence becomes inadmissible

    In both cases the Federal Judge found that traffic law had been violated. However, as no other person was actually put in danger the stop was unnecessary or unwarrented. So he fiound for the defendant and the resulting evidence from the traffic stop was not admissible. Both bad guys walked.

    My suggestion was refile in a state district court, but since a federal judge had made a finding. Our local DA will not take the cases.

    There you have it. Not only does a traffic stop have to be an obvious violation of the law. It now has to endanger another before it is warranted or necessary.

      So now the way I see it is breaking the law is completely acceptable, even if you are caught. Traffic laws don't mean shit. Theft laws don't mean shit. Why do we even have police anymore? Y'all just wasting your time and taxpayer dollars trying to enforce laws that don't even fucking matter anymore. It's complete nonsense and I know it ain't the fault of the cops.

              Traffic laws are mostly chickenshit revenue generators for the cities and departments overzealously enforcing them. If the FIVE OH hadnt' been oh so gung ho on these things and focused more on crimes where people get hurt physically or financially, there would not be so much public outrage about it. Quotas and red light cameras - you sowed, now reap it. zero sympathy for "traffic cops."

                You need to come stay in H-town for a week at Dane's, watch the local news and let him take you on a tour of the town, its the wild west out here.
                Had the same 2 perps ran from the laws, the Popo would have likely pulled off of the pursuit, because it "Endangered the Public".
                These mfers are out of control and LEO would rather make enforcement decisions based on what they think the DA is going to do with the bad guy once they catch him. Its a bad position for the Law Dog to be in, but they helped create it when they stopped doing their jobs during the defund the police era.
                Sadly what few good cops are left, are coasting to the finish line trying to not fuck up their happily ever after while they are being replaced with turds that wouldn't have made the interview process 20 years ago.

                Nothing is going to change until the population centers replace these Liberal Criminal Court Judges with Conservative Judges, until then its just going to get mo worser.

                  It sounds horrible. Especially that part about staying at Dane's. But, yeah. It's not that bad here yet, but it's coming.

                    You'd be perfectly safe staying at my place.....I'm not in the city of houston. We have our own cops, and unlike most these days, they do the job they're supposed to do. Essentially zero crime in my hood.

                      Three years. Unless THEY frustrate me. Right now it is still just a game to me, and games are fun.

                              Fuck that judge.

                              Constantly on news up here. Some guy gets busted for drugs and it always starts with a traffic stop. I would think that if I had a car full of dope, that I would obey all the traffic laws. So I suspect that the cops already know what they are up too via profiling or prior surveillance and just make up a reason to stop the bad guy. Is it really profiling if the cops are right about it? Profilies and stereotypes exist for a reason.
